Can a police officer give a panger in a car a seatbelt ticket if the seatbelt was broken?

I got a seatbelt ticket in California - Alameda county but the seatbelt was broken and he did not issue the driver a fix it ticket. Is this something I can fight in court? The ticket is $400.
